The Balance Between Executive And Legislative Powers In Light Of The 2020 Constitutional Amendment: A Formal Equilibrium Or An Embodiment Of Democracy?

Résumé: The reformation of the separation of powers principle in Algeria, notably after the constitutional amendment in 2020, exemplifies a dynamic adaptation emphasizing the uniqueness and autonomy of the governmental triad. This framework facilitates mechanisms of cooperation and mutual oversight between the legislative and executive branches, aimed at maintaining equilibrium. Nonetheless, opinions among Algerian legal scholars vary regarding the effectiveness of this balance. Some commend the constitutional framers for empowering these branches, while others critique these powers as superficial in comparison to the dominant presidential powers. إن تطبيق مبدأ الفصل بين السلطات في الجزائر في ظل التعديل الدستوري 2020 ،يكرس فكرة التطبيق المرن للمبدأ وذلك بالاعتماد على فكرة تخصص واستقلالية كل سلطة من السلطات الثلاث عن الاخرى هذا من جهة ، ومن جهة أخرى منح كل من السلطة التشريعية والتنفيذية آليات التعاون فيما بينها ،وآليات رقابة متبادلة بين هاتين السلطتين تعمل على توازن كفتيهما . لكن اختلف فقهاء القانون في الجزائر على مدى وظيفية هذا التوازن ، فهناك من ثمن منح المؤسس الدستوري هاته الصلاحيات وهناك من رآها صلاحيات شكلية مقارنة بصلاحيات رئيس الجمهورية.
