Résumé: يحتل موضوع عقد امتياز الأراضي الفلاحية مكانة هامة في التشريع الجزائري مردها الى الأهداف المرجوة منه في الحفاظ على الأملاك الوطنية والأراضي الفلاحية، كما أنه من شأنه المساهمة في النهوض بقطاع الفلاحة وجعله بديلا عن المحروقات في الاقلاع بالتنمية الاقتصادية، ويعتبر حق الامتياز نظام جديدا في السياسة العقارية المنتهجة منذ الاستقلال، لذلك أولاه المشرع الجزائري أهمية بالغة في الأحكام التي تنظمه، من خلال تعزيز الدور الرقابي لهيئات الدولة في استغلال الأراضي الفلاحية، وكرس حق استرجاع الأراضي الفلاحية عند الاخلال إخلال صاحب الامتياز بالالتزامات الملقاة على عاتقه. The concession contract of agricultural land occupies an important place in Algerian legislation due to its objectives of preserving national property and agricultural lands. It will also contribute to the advancement of the agricultural sector and make it an alternative to hydrocarbons in promoting economic development. The concession is a new system of real estate policy. Therefore, the Algerian legislator gave a great importance to the provisions that regulate it through strengthening the supervisory role of state agencies over the exploitation of agricultural lands, as well as he consecrate the right to restore agricultural lands in case when the concessionaire breaches the obligations imposed On him.
