التعاون الدولي كآلية لمكافحة الفساد

Résumé: تحث الدول الأطراف على اتخاذ ما هو ممكن من تدابير وإجراءات، قصد تحقيق أغراض هذه الاتفاقية وعلى رأسها ترویج وتدعيم التدابير الرامية إلى منع ومكافحة جرائم الفساد بصورة أكفأ وأنجع، والجزائر كبقية الدول، ووفاء منها لالتزاماتها الدولية، وإرادة منها لمكافحة أشكال وأنماط الفساد بشتى أنواعه، سنت القانون الخاص الذي يعني بالوقاية من الفساد ومكافحته، كما استحدثت أحكاما موضوعية وإجرائية لم تعرف من قبل في قانون العقوبات. وأكد المشرع على ضرورة اتخاذ التدابير اللازمة لمواجهة الفساد سواء كانت تدابير قبل ارتكاب الجريمة (تدابير وقائية)، أو كانت تدابير في إطار تسهيل ودعم التعاون الدولي والمساعدة التقنية من أجل الوقاية من الفساد ومكافحته، بما في ذلك استرداد الموجودات وسيتم البحث بدراسة مظاهر التعاون بين الدول على المستويين الأمني والقضائي المواجهة جرائم الفساد، على اعتبار أن التعاون الأمني والقضائي يعتبر شرطا أساسيا النجاح السياسة الجنائية في مكافحة الجريمة المنظمة عموما والفساد على وجه الخصوص. Abstract:Urges the States Parties to take the possible measures and procedures, with a view to achieving the purposes of this Convention, foremost of which is the promotion and support of measures aimed at preventing and combating corruption crimes in a more efficient and effective manner, and Algeria is like other countries, fulfilling its international obligations and willingness to combat all forms and types of corruption; It enacted the special law concerned with preventing and combating corruption, as well as introducing substantive and procedural provisions not previously known in the Penal Code. The legislator stressed the need to take the necessary measures to confront corruption, whether they were measures prior to committing the crime (preventive measures), or measures within the framework of facilitating and supporting international cooperation and technical assistance in order to prevent and combat corruption, including asset recovery. The study of manifestations of cooperation between countries will be discussed. At the security and judicial levels, corruption crimes are confronted, given that security and judicial cooperation is a prerequisite for the success of criminal policy in combating organized crime in general and corruption in particular.
