إشكالية الاختصاص النوعي للقضاء الوطني في فض منازعات عقود الاستثمار الدولية في الجزائر

Résumé: تتميز عقود الاستثمار الدولية بعدم وجود تشريع موحد لها، سواء على الصعيد الدولي او الإقليمي فهي من الموضوعات المتشعبة والمتشابكة ، فهي تخضع لأكثر من فرع من أفرع القانون بمختلف تخصصاته ، الأمر الذي يخلق العديد من الإشكالات من ناحية مفهومها وأطرافها أو توصيفها القانوني ، ولو أن مسالة فض منازعاتها محدد وموزون بين سلطان الدولة و سلطان إرادة الطرفين التي غالبا ما يلجأ أطرافها إلى وسيلة التحكيم كبديل عن القضاء الوطني المختص إقليميا ، فمسالة تبين الحدود التي تباشر فيها محاكم الدولة في الجزائر متى ارتضاها الأطراف لحل ما ثار بينهم من نزاعات – أطراف عقد الاستثمار الدولي- يطرح إشكال أخر على اعتبار أن الجزائر تأخذ بالازدواج القضائي وبالتالي الفصل في نوعية المنازعات بين ماهو عادي أو إداري وهو ما تم معالجته من خلال هذه الورقة البحثية. International investment contracts are characterized by the absence of a unified legislation for them, whether at the international or regional level. They are among the manifold and intertwined issues, as they are subject to more than one branch of law in its various disciplines, which creates many problems in terms of its concept, parties or legal description. If the issue of settling its disputes is specific and weighed between the authority of the state and the authority of the will of the parties, whose parties often resort to the means of arbitration as an alternative to the national judiciary that is regionally competent, then it is an issue that shows the limits within which the state courts in Algeria can proceed when the parties agree to resolve the disputes that arose between them Another problem arises, given that Algeria adopts judicial duality, and thus the separation of disputes between what is normal or administrative, which is what was addressed through this research paper.
