Résumé: تعبر آلية الدفع بعدم الدستورية عن حق الفرد في الاعتراض على تطبيق نصوص قانونية قد تتحكم في نزاع يكون طرفا فيه أمام إحدى الجهات القضائية، يرى أنها تمس حقوقا وحريات يضمنها له الدستور، غير أن ممارسته لهذا الحق مرهونة بمدى توفر دفعه على شروط معينة، وكذا إجراءات تهدف إلى تصفية الدفع على مستوى القضاء قبل إحالته على الهيئة المكلفة بالبت فيه، بما يوحي ظاهريا بتداخل عمل هذه الأخيرة والجهات القضائية في النظر في الدفع، وكان للاجتهاد الدستوري رأيه الحاسم في رسم معالم تدخل كل جهة في مجال الدفع بعدم الدستورية. Abstract : The mechanism of payment of unconstitutionality is represented by the individual's right to object to the application of legal texts that may apply to a dispute that is a party in front of one of the judicial authorities, who believes that it affects rights and freedoms guaranteed by the constitution, but his practice of this right depends on the extent of his payment of certain conditions, As well as procedures aimed at liquidating payment at the level of the judiciary before referring it to the body in charge of it, in a way that apparently suggests the overlapping of the work of the latter and the judicial authorities in consideration of payment, and the constitutional jurisprudence had his decisive opinion on drawing the features of each party’s intervention in the field of impulsivity in unconstitutionality.
