Résumé: ملخص: تتناول هذه الدراسة سلطة القاضي (العادي والدستوري) بتفسير النصوص الدستورية في آلية الدفع بعدم الدستورية، وتكمن أهمية ذلك في معرفة كيفية إعمال قواعد التفسير من قبل المتدخلين في الآلية، بما يضمن سمو الدستور واستبعاد القوانين والتنظيمات المطعون فيها من التطبيق على موضوع النزاع المطروح على القضاء. من خلال ممارسة قاضي الموضوع لسلطته التفسيرية أثناء تقدير جدية الدفع، والتي يحسمها القاضي الدستوري بموجب الإحالة عليه. ونتيجة لذلك، لا يمكن اعتبار أن القاضي لديه "الكلمة الأخيرة" في عملية التفسير، لأن قرار المحكمة الدستورية يؤسس الصياغة النهائية لمفهوم التفسير المعياري المعتمد في الدفع بعدم الدستورية. Abstract: This study deals with the authority of the judge (ordinary and constitutional) to interpret constitutional texts in the mechanism of arguing unconstitutionality, and the importance of this lies in knowing how to implement the rules of interpretation by the interveners in the mechanism.
