الحماية الجزائية للطفل في القانون رقم 15-12

Résumé: الملخص: المشرع الجزائري من خلال القانون رقم 15-12 المتعلق بحماية الطفل وضع سياسة جنائية خاصة تهدف لحماية الطفل في حالة خطر، والطفل الجانح، والطفل ضحية بعض الجرائم، وذلك من خلال وضع آليات قانونية خاصة تهدف لحماية الطفل وتربيته وتهذيبه. يشارك في هذه الحماية إلى جانب السلطة القضائية عن طريق قاضي الأحداث المجتمع وبصفة أساسية الأسرة باعتبارها الوسط الملائم لنمو وتربية الطفل، مع توفير الحماية الاجتماعية عن طريق إحداث هيئات خاصة تتمثل في اللجنة الوطنية لحماية الطفولة، ولجان الوسط المفتوح تحت إشراف قاضي الأحداث الذي لا ينتهي دوره بالنطق بالعقوبة، أو الإجراء المطبق على الطفل، وإنما يمتد إلى غاية تنفيذه واستبداله في حالة الضرورة بما تقتضه مصلحة الطفل. Abstract: The Algerian legislator, through Law No. 12-15 related to child protection, developed a special criminal policy aimed at protecting the child in danger, the delinquent child, and the child victim of some crimes, through the development of special legal mechanisms aimed at child protection, education and discipline. In addition to the judicial authority, the community participates in this protection through the juvenile judge, mainly the family as the appropriate environment for the growth and upbringing of the child, while providing social protection through the creation of special bodies represented in the National Committee for the Protection of Childhood, and the open media committees under the supervision of the juvenile judge whose role does not end. Pronouncing the punishment or the procedure applied to the child, but extending it to the end of its implementation and replacing it, in case of necessity, with what is required in the interest of the child.
