المسائل الواردة على خلاف قياس الأصول في كتاب بداية المجتهد لابن رشد (ت:595ه) كتاب البيوع أنموذجا - جمعا ودراسة -

Résumé: يتناول البحث المسائل الواردة على خلاف قياس الأصول في كتاب بداية المجتهد للعلامة الفقيه المجتهد ابن رشد الحفيد، وذلك من خلال تتبع واستقراء المسائل الواردة كذلك في كتاب البيوع منه خاصة، ثم القيام بدراستها؛ ببيان صورة المسألة الفقهية الواردة على خلاف قياس الأصول، ثم ذكر أهم مذاهب الفقهاء في المسألة، ثم الحرص على ذكر وجه مخالفة المسألة المذكورة لقياس الأصول، وقد تمّ التوصّل إلى نتائج مهمة من خلال هذا البحث منها: الوقوف على أن مقصود الأصوليين من قولهم هذا على خلاف القياس، أو الأصول إنما يُقصَد عندهم به قياس الأصول المتمثّل في القواعد العامة المقرّرة شرعا، كما عُلِم من خلال هذه الدراسة أن الأحناف هم أكثر المذاهب ردّا للأدلة الظنية إذا وردت على خلاف قياس الأصول، ثم يليهم بعد ذلك المالكية. Abstract: The research deals with the issues mentioned in contrast to the measurement of the fundamentals in the book Bidayat al-Mujtahid by the scholarly jurist Ibn Rushd the grandson, by tracking and extrapolating the issues mentioned so in the book of sales from it in particular, and then studying them by explaining the image of the jurisprudential issue mentioned in contrast to the measurement of origins, then mentioned the most important doctrines of the jurists in the issue, then keen to mention the way in which the aforementioned issue contravenes the measurement of the fundamentals. Otherwise through this research important results were reached; it turns out the intention of the fundamentalists in saying this is contrary of the analogy, or the fundamentals that’s meant measuring assets, and it is also learned through this study that the Hanafis are the most refusal of the presumptive evidence if it is mentioned in contrast to the measurement of the assets, then followed after that by the Malikis.
