استغلال العقار الموجه للاستثمار في ظل الأمر 08-04

Résumé: اعتمد المشرع الجزائري بموجب الأمر 08-04 الذي يحدد شروط و كيفيات منح الامتياز على الأراضي التابعة للدولة و الموجهة لانجاز مشاريع استثمارية سواء كانت صناعية او سياحية ، على عقد الامتياز غير القابل للتنازل كآلية لاستغلال تلك الاراضي ، لذا ستنصب الدراسة على شروط و كيفية إبرام هذا العقد و مختلف المراحل التي يمر بها و كذا الآثار المترتبة على تنفيذه، و ذلك بالتطرق لحقوق المستثمر و التزاماته، و كذا كيفية تسوية مختلف النزاعات الناشئة عنه سواء كانت مطروحة أمام القضاء الإداري أو العادي ، أو تم اللجوء لإحدى الطرق البديلة. Abstract: The algerian legislator,by virtue of ORdinance 08-04 , which specifies the conditions and modalities for granting concessions on state lands and directed to the implementation of investmentprojects, whether industrial or tourism, has approved the non-waiverable concession contract as a mechanism for the exploitation of those lands, so the study will focus on the conditions and how to conclude this contract and the various stages it goes through, as well as the implications of its implementation, by addressing the investor's rights and obligations, as well how to settle the varioys disputes arising from whether they are brought before the administrative or ordinary judiciary, or an alternative method is resorted to
