إشكالات تحويل حق الانتفاع الدائم الممنوح للمنتجين الفلاحيين في إطار القانون رقم 87-19 إلى حق امتياز

Résumé: الملخص بالعربية عرفت عملية تحويل حق الانتفاع الدائم الممنوع في ظل القانون السابق رقم 87-19 إلى حق امتياز تطبيقا لأحكام القانون رقم 10-03، إشكالات عديدة حالت دون إتمام العملية في آجالها القانونية، وإلى يومنا هذا منذ 18 أوت 2010 تاريخ صدور القانون رقم 10-03 في الجريدة الرسمية. وتتمثل هذه الإشكالات في قيام عدد كبير من المنتجين الفلاحيين بالتنازل عن حقهم في الانتفاع الدائم بعقود غير ناقلة للملكية ، سواء كانت عقود توثيقية لكنها غير مشهرة، أو بعقود عرفية رغم بطلان هذه الأخيرة بطلانا مطلقا. فضلا على إشكالية النزاعات القضائية المطروحة على القضاء بنوعيه والتي لم يتم الفصل في بعضها إلى يومنا هذا حالت دون إمكانية دراسة الملفات المعنية من طرف الديوان الوطني للأراضي الفلاحية ، وكذا إشكالية الفارق في مساحة الوعاء العقاري للمستثمرة الفلاحية بعد إجراء عمليات اقتطاع، أو استرجاع أو نزع الملكية قامت بها الدولة لهذه الأراضي لاستغلالها لأغراض البناء، وكذا مشكلة الأحواش والأبنية غير المشروعة المقامة عليها، مما أدى كل هذا إلى تعطيل عملية تعميم عقود الامتياز على كل المستثمرات الفلاحية إلى يومنا هذا. الملخص بالإنجليزية The transfer of the permanent right of use prohibited under the previous law not 19-87 to the right of privilege in application of the provisions of law npt 10-03 defined many problems whith prevented the completion of the process within its legal deadlines to date 18 August 2010 law dat 10-03 official gazette These are the problems in whith a large number of agricultural producers producers relinquish their right to permanent use of non transferable contracts , whether documented or unregistered , or by customary contracts , despite their invalidity , As well as the problem of judicial disputes on the judiciary in its two types , which have not been separated in some of them to this day provented the possibility of studying the national Bureau of agricultural lands , as well as the problem of difference in the area of the housing container for the agricultural investor after the process of deduction , and illegal buildings built on them, which has led to the disruption of the process of generalization of concession contracts to all agricultural investors to the present day
