حماية حق المحضون في النفقة على ضوء القانون رقم 24-01.

Résumé: يعد التقصير والإمتناع عن دفع النفقة المستحقة للأطفال المحضونين أحد أهم المشكلات الإجتماعية التي تعج بها ساحات القضاء والتي تتباين أسبابها من امتناع إلى عجز أو إعسار، وكلها تؤدي إلى نتيجة واحدة هي تأخير تسديد النفقة في حينها . يدخل القانون رقم 24-01 في إطار المسار الهام الذي تحذوه الدولة في مجال الحصول على النفقة حرصا على تجسيد العدالة الاجتماعية، وتعزيز حقوق المحضون و الحاضن وترقيتها وكذا تعزيز آليات التحصيل. تهدف هذه الدراسة إلى إلقاء الضوء على التدابير الخاصة التي جاء بها القانون رقم 24 -01 للحصول على النفقة المحكوم بها قضاء للطفل المحضون، ومدى كفاية هذه التدابير لضمان صيانة حقه في النفقة، وكذا بيان مدى نجاعة المقتضيات القانونية لصندوق النفقة في حماية حق المحضون،وإن كان يصعب في الوقت الراهن تقييمه نظرا للمستجدات التي جاء بها ووضعه تحت سلطة وزارة العدل وغياب الإجتهاد القضائي لعدم إمكانية الطعن في الأوامر الصادرة. Abstract: The failure and refusal to pay child alimony owed to children in custody is one of the most significant social issues facing the courts, with causes ranging from refusal to inability or insolvency, all leading to the same outcome: the delay in paying child alimony on time. Law No. 24-01 falls within the important course the state is pursuing in the field of obtaining alimony in order to embody social justice, enhance and promote the rights of both the child in custody and the custodial parent, and enhance collection mechanisms. The purpose of 24-01 is to obtain court-ordered alimony for a child in custody, and to evaluate the effectiveness of these measures in protecting the child's right to alimony. It also seeks to assess the effectiveness of the legislation relating to Child Alimony Fund in protecting the rights of the child, although this is currently difficult to assess due to the recent developments introduced, the fact that it is under the authority of the Ministry of Justice and the lack of jurisprudence, given that the orders issued are not subject to appeal.
