فاعلية ضمانات المؤمن له خلال مرحلة التسوية القضائية للنزاع الطبي

Résumé: الملخص: لقد ضمّن المشرع الجزائري كلاًّ من القانون المتعلق بالمنازعات في مجال الضمان الاجتماعي وقانون الإجراءات المدنية والإدارية العديد من الضمانات لفائدة المؤمن له في مرحلة التسوية القضائية للنزاع الطبي ، يمكن إجمالها في تمكينه من حق الطعن أمام المحاكم الابتدائية في قرارات لجان العجز الولائية وفي قرارات هيئات الضمان الاجتماعي المتمخضة عن نتائج الخبرة الطبية، هذا ناهيك عن الضمانات المتعلقة بالسلطات التي يتمتع بها القاضي أثناء سير الخصومة، وهي ضمانات يمكن وصفها بالفعالة. Abstract: Into both the law on disputes of social security and the code of civil and administrative procedures the Algerian legislator has included many guarantees for the benefit of the insured at the judicial settlement phase of the medical dispute; which can be summarized in the right to appeal to the courts against decisions of disability committees and decisions of social security related to the medical expertise, in addition to guarantees related to the powers that the judge enjoyed during the course of the litigation, which can be described as effective
