ضمانات حماية حق المريض من خلال المنازعة الطبية في مواجهة قرارات هيئات الضمان الإجتماعي وفق أحكام القانون رقم 08/08

Résumé: الضمان الإجتماعي من الأنظمة الفعالة التي تضمن للعامل الأجير الحماية مما قد يتعرض له هذا الأخير من أخطار بما في ذلك خطر المرض، إلا أن المؤمن له قد لا يحصل على الحقوق المخولة له بما يلبي إحتياجاته بسبب المرض فتكون قرارات هيئة الضمان الاجتماعي موضوع مخاصمة، ولهذا فقد وضع المشرع آليات لعلاجها، وتشمل التسوية إما وديا لما يقتنع المؤمن له مما يقدم له من صندوق الضمان الإجتماعي من تعويض أو غيرها من الخدمات بعد الفحص الذي يتلقاه من الطبيب المعالج أو الطبيب المستشار حسب كل حالة، أما إذا جاءت قرارات هيئة الضمان الإجتماعي أو لجان العجز مجحفة في حق المؤمن له فلا سبيل له غير اللجوء إلى القضاء للحصول على مستحقاته قضاءا. Abstract :Social security is an effective system that guarantees the insured protection against the risks that may be posed to him, including the risk of illness. However, the insured may not receive the rights granted to him to meet his needs due to illness. The legislator has put in place mechanisms to remedy them. The settlement includes either an amicable settlement of the insured person being satisfied with he social security fund provided for compensation or other services after extamination by the treating physician or the counselor doctor in each case.
