موت الدّماغ وأثره في نقل وزراعة الأعضاء البشريّة: دراسة فقهيّة قانونيّة Brain Death And Its Impact On The Transfer And Transplantation Of Human Organs: A Medical, Jurisprudential, And Legal Study

Résumé: أحدث موضوع زراعة الأعضاء البشرية خلافا بين الأطبّاء والفقهاء والقانونيّين، حيث أنّ حكم موت الدّماغ وأثره في عمليّة نقل وزراعة الأعضاء البشريّة عُدَّت من المسائل الشائكة في هذا المجال؛ حيث أنّ الدّماغ الحقيقي أو الحكمي هو الفيصل في عمليّة نقل وغرس الأعضاء البشريّة برمّتها؛ وكون زراعة الأعضاء البشرية يكون من حيّ إلى حيّ، أو من حيّ إلى ميّت وهو النّوع الذي استحكم فيه الخلاف، وتفرّع عنه المسألة الخلافيّة التي تتعلّق بمدى جواز إيقاف أجهزة الإنعاش الصّناعيّ وهذه المسألتان هما أساس الاشكالية المطروحة في هذا المقال الذي من خلاله أراد الباحث تجلية ذلك وبيانه، فسعى للتحقيق فيهما وعرض آراء الفقهاء المُؤسس على رأي الأطباء، وبيان القوانين الوضعيّة وما يترتّب عليها من اجراءات؛ وكل ذلك من خلال المنهج التحليلي المقارن. وجاءت خطة البحث من مقدمة وثلاثة مباحث، الأول في الجانب الطّبّي، والثاني في الجانب الفقهي، أمّا المبحث الثالث ففي الجانب القانوني، وتضمنت الخاتمة أهمّ النتائج والتوصيات The topic of human organ transplantation has caused a dispute between the doctors, jurists and legal, as the ruling on the death of the brain and its effect on the process of transmitting and cultivating human organs was prepared from thorny issues in this field; As the real or judgmental brain is the criterion in the process of transferring and planting the entire human organs; And the fact that the cultivation of human organs is from alive to alive, or from alive to dead, which is the type in which the dispute is ruled, and the controversial issue that relates to the extent of the permissibility of stopping the artificial resuscitation devices. These two issues are the basis of the problem presented in this article, through which the researcher wanted to clarify and explain this, so he sought to investigate them and present the opinions of jurists based on the opinion of doctors, and explain the positive laws and the procedures that result from them. All of this is done through the comparative analytical approach. The research plan consisted of an introduction and three sections, the first on the medical side, the second on the jurisprudential side, and the third section on the legal side, and the conclusion included the most important results and recommendations.
