أحكام الموت الدماغي للإنسان والتصرف في أعضائه Rulings Of Human Brain Death And The Disposition Of Its Organs

Résumé: من النوازل المعاصرة: الموت الدماغي؛ فما حكمه؟ وهل يمكن التصرف في أعضاء صاحبه؟. والهدف من هذه الدراسة بيان الموقف الشرعي من الموت الدماغي وما يتعلّق به من أحكام، ولتحقيق ذلك استخدمت منهجين: الوصفي، والتحليلي، وكان من نتائج هذه الدراسة: أنّه لا يحكم بالموت بمجرد موت "جذع المخ"، مع جواز نزع أجهزة الإنعاش عنه في حالة اليأس من شفائه. وكذلك يجوز نقل الأعضاء من المريض بموت الدماغ بإذن سابق منه، أو بإذن ورثته. The aim of this study is to clarify the legal position on brain death and related rulings. The despair of his recovery. Likewise, it is permissible to transfer organs from a patient with brain death with his prior permission, or with the permission of his heirs.
