فلسفة العطلة الاستثنائية للموظف لإنشاء مؤسسة في ضوء معايير الجودة في صناعة القانون

Résumé: تهدف الدراسة لاستقصاء أثر التشريع كأداة قانونية مفعلة لدور الموظف في تحقيق التنمية الاقتصادية، الهدف البارز في سياسة الدولة، وفق منظور جسده تكييف القانون الأساسي العام للوظيفة العمومية، بتبني مفهوم العطلة الاستثنائية لإنشاء مؤسسة بتتميمه بالقانون 22-22 ،والعطلة الاستثنائية ضمن القواعد الإجرائية المنظمة لها آلية عبور مرتكزة على ضمان الاستقرار للمركز القانوني للموظف في مرحلة إنشاء المؤسسة وقبل إنهاء علاقته بالإدارة المستخدمة بنجاح مشروعه أو عدم طلب إدماجه، المحاور المجسدة في المادة206 مكرر1 و6، في اتجاه آخر يثير التتميم على أصل النص إشكالية مراعاة الانسجام وعدم التعارض والنقص في القانون في ظل علاقة النص موضوع التتميم بما تضمنه الأمر رقم 06-03. The study aims to investigate the impact of legislation as an active legal tool for the role of the employee in achieving economic development, the prominent goal in the state’s policy, according to a perspective embodied by the adaptation of the General Basic Law of the Public Service, by adopting the concept of exceptional leave for the establishment of an institution by complementing it by Law 22-22 and the exceptional leave within the procedural rules regulating its transit mechanism based on ensuring the stability of the employee’s legal status at the stage of establishing the institution and before terminating his relationship with the administration used for the success of his project or not requesting its integration, the axes embodied in Articles 206 bis 1 and 6, in Another trend that raises the problem of taking into account the consistency, non-conflict and deficiency of the law in light of the relationship of the text subject to the completion to the contents of Ordinance No. 06-03
