الالتزام بالإعلام قبل التعاقدي كوسيلة لحماية المستهلك في عقد البيع الإلكتروني

Résumé: كان للتطور التكنولوجي والمعلوماتي أثر كبير في إنتشار الأنترنت وشيوع معاملات التجارة الإلكترونية، فأصبحت تتم عن طريق وسائل الاتصال الحديثة، ولنجاح هذه العقود الإلكترونية والتي ترتبط أساسا بالعملية الاستهلاكية، كان لابد من توفير الحماية القانونية للمستهلكين والمتعاملين بصفة عامة، خاصة أن العقود تبرم عن بعد، وفي كثير من الأحيان يجهل المستهلك نطاق التزامه وتعاقداته، والأكثر من ذلك فهو يجهل حتى الشخص الذي يتعاقد معه، ولترسيخ الثقة بين أطراف هذه العقود فكان لابد من تنوير رضائه قبل التعاقد وذلك عبر إعلامه بكل الأوصاف والمعلومات من طرف البائع المهني الذي يفوقه خبرة وكل ذلك من أجل إرساء علاقة الثقة بالطرف الذي يتعاقد معه وما يتعلق بمحل التعاقد، فلابد من معرفة معنى هذا الالتزام والآثار المترتبة عن الإخلال به. Technological progress has a significant impact on the spread of the Internet and the prevalence of e-commerce transactions made by modern means of communication. In order to succeed in these electronic contracts mainly related to the consumption process, it was necessary to provide legal protection for consumers and dealers in general, in particular distance contracts where the consumer is often unaware of the impact of his commitment and contracts, in addition to the person with whom he is linked by this contract. Thus, and to establish trust between the parties to these contracts, it was necessary to clarify his consent before the contract, and this by arming him with all descriptions and information by the professional salesman more experienced than him, the whole, to establish a relationship of trust relating him with this contract and its place, hence the need to know the meaning of this commitment and the consequences of its derogation.
