الجزاء الإداري كآلية لحماية البيئة

Résumé: إن الآليات الضبط الإداري البيئي، إما أن تكون وقائية غايتها منع وقوع الأضرار البيئية أو إمكانية التقليل منها، وتكون في صورة الترخيص الذي يعتبر وسيلة قبلية مسبقة لحماية البيئة وصورة من صور الرقابة الإدارية، أما الصور الأخرى لتدخل الإدارة يكون عن طريق الآليات الردعية. يعد سحب أو إلغاء الترخيص من أشد وأخطر أساليب الضبط الإداري البيئي، ذلك أنه يكون في شكل جزاءات توقعها سلطات الضبط لمواجهة المخالفات البيئة الخطيرة المرتكبة من قبل المؤسسات أو الأشخاص عند ممارستهم لنشاطاتهم، وقد تكون عبارة عن جزاءات مالية وهو ما يعرف بالرسم على التلوث. The mechanisms of environmental administrative control are either preventive with the aim of preventing the occurrence of environmental damage or the possibility of minimizing them, and they are in the form of licensing, which is a priori means of protecting the environment and a form of administrative control, while other forms of management intervention are through deterrent mechanisms. The withdrawal or cancellation of the license is one of the most severe and most dangerous methods of environmental administrative control, as it is in the form of penalties imposed by the control authorities to confront serious environmental violations committed by institutions or persons when carrying out their activities. It may be financial penalties, which is known as the pollution fee.
