فاعلية الضبط الإداري في تحقيق الأمن البيئي في التشريع الجزائري

Résumé: تنصب هذه الدراسة حول فاعلية الضبط الإداري في تحقيق الأمن البيئي في التشريع الجزائري ، حيث توصلنا إلى أن لسلطات الضبط الإداري استعمال أليات وقائية قبلية في سبيل حماية البيئة من كل تهديد قد يمسها فلها استعمال، إما أسلوب الحظر، أو الإلزام ، أو نظام التراخيص،و كذا نظام التقارير ، أو دراسة التأثير للمشاريع ، كما لها استعمال وسائل ردعية عقابية في مواجهة المخالفين للتشريعات البيئية من إنذار ، أو غلق مؤقت ،أو سحب الرخص ، أو فرض الغرامة المالية ، هذا ما يجعل من الضبط الإداري من أنجع الوسائل لحماية البيئة نظرا للسلطات الواسعة التي تحوزها الإدارة في سبيل ضمان بيئة سليمة للعيش بها. This study focuses on the effectiveness of the administrative police (administrative control) in achieving environmental security in the Algerian legislation, Where we concluded that the administrative control authorities use preventive measures in order to protect the environment from any damage that may affect it,They can use either the prohibition, the bindingmethod, or the licensing system, the reporting system, or the impact study for projects,As they can use punitive deterrent measures against environmental legislationviolators,that varies From warning, temporary closure, withdrawal of licenses, imposition of a fine.All of this makes the administrative police one of the most effective means of the environmentprotectiongiven the extensive powers the administration holds in order to ensure a healthy environment for living.
