تكييف التعاقد الآلي عبر الانترنت- مقاربة شرعية وقانونية

Résumé: الملخص: تهدف هذه الورقة البحثية إلى دراسة طبيعة التعاقد عبر الانترنت من خلال مقاربة شرعية وقانونية، محاولة للبحث عن تكييف مناسب للعقود التي تبرم بطريقة آلية عبر الانترنت، هذه العقود التي تشكل اليوم الجزء الأكبر من أشكال التعاقد عبر الانترنت (التسوق الالكتروني). توصلت الدراسة إلى أن التكييف الأقرب للعقود التي تتمّ آليًا عبر الانترنت هو اعتبارها عقود تمت عن طريق وسيط الكتروني ناقل للإرادة، وكنتيجة لذلك تنسحب عليها أحكام العقود العادية التي تتمّ بواسطة الكتابة، والبريد، والإشارة، وهي مبسوطة في كتب الفقه والقانون. كلمات مفتاحية: التعاقد الآلي، البيع عبر الانترنت، التعبير عن الإرادة. Abstract: This research paper examines the nature of Internet contracts through Islamic jurisprudence and legal approach by searching for the appropriate description of automated Internet contracts, these contracts that constitute today the largest forms of Internet contracts through electronic shopping sites. The paper concluded that the automated Internet contracts is considered as an ordinary contracts through an electronic intermediary that transmit the will, and as a result, their rules are the same as those of ordinary contracts made by writing, mail and gesture, these rules are mentioned in the books of jurisprudence and Islamic law. .Keywords: Internet contracts; automated Internet contracts. .
