الحماية القانونية للسكينة العامة بين التشريع الجزائري والتشريعين الفرنسي والمصري The Legal Protection Of Public Tranquility Between Algerian And French And Egyptian Legislation

Résumé: تستهدف هذه الدراسة معالجة المنظور التشريعي لمسألة حماية السكينة العامة وهذا من خلال إبراز مدى فاعلية الوسائل القانونية المكفولة لمختلف هيئات الضبط الإداري بغرض تحقيق تلك الحماية،ولعل أهم نتائج البحث تظهر في عدم إفراد المشرع لقانون مستقل متعلق بالضوضاء،وضعف تلك الهيئات في مكافحتها،وكذا هشاشة الآليات المخولة لها وشكلية الجزاءات المقررة لذلك، وأيضا ضعف الوعي البيئي لدى الأفراد وهو ما ترجمته قلة نشرهم للدعاوى والشكاوى للهيئات المختصة عن الإخلال بالسكينة العامة. This study aims to address the legislative perspective of the issue of the protection of public tranquility by highlighting the effectiveness of the legal means guaranteed to various administrative control bodies for the purpose of achieving such protection, and perhaps the most important research results show that the legislator does not devise an independent law related to noise, and the weakness of those bodies in the fight against, as well as the fragility Mechanisms entrusted to them, as well as the formality of sanctions prescribed for them, and also the lack of environmental awareness among individuals, which is translated by the lack of dissemination of cases to the competent bodies for breach of public tranquility
