الحماية الجنائية للجسم البشري من جريمة الاتجار بالأعضاء في ظل القانون 09 / 01

Résumé: الاتجار بالأعضاء البشرية مأساة إنسانية حقيقية، وهي جريمة عالمية يترتب عليها آثار اجتماعية وصحية واقتصادية خطيرة، لذلك دأب المجتمع الدولي على الاهتمام بمكافحة هذه الجريمة البشعة والحد منها، وأصدرت العديد من الدول نصوص قانونية خاصة بمكافحة هذه الجريمة، ونظرا لطبيعتها الخاصة وحداثتها خاصة في الجزائر التي ليست بمنأى عن هذه الظاهرة، ارتأينا أن نتعرض لها بالدراسة من خلال إبراز الجانب القانوني للجريمة ومعرفة مدى فاعلية تعديل مكافحة أفعال الاتجار بالأعضاء البشرية في قانون العقوبات الجزائري. Trafficking in human organs a real humanitarian tragedy, a global crime that entails serious social, health and economic impacts, so the international community has always to pay attention to the fight against this heinous and reduce crime, and issued many countries, especially the fight against this crime, legal texts, due to their special nature, particularly in Algeria, and timeliness that is not immune to this phenomenon, we decided that we are exposed to the study by highlighting the legal aspect of the crime and find out the effectiveness of the amendment combat acts of trafficking in human organs in the Algerian Penal Code.
