أثر تقسيم الجريمة في التشريع الجنائي الإسلامي وقانون العقوبات الجزائري The Impact Of The Division Of Crime In Islamic Criminal Legislation And The Algerian Penal Code

Résumé: إن النزعة البشرية المتأصلة في الإنسان تبحث دائما عن الرفاه والاستقرار إلا أنها تصطدم بنظام الكبت الاجتماعي الذي يعد القانون أهمها لارتباطه بجزاءات تمس الحرية والسلامة الجسدية في حالة تهديد المصالح الجديرة بالحماية بالعدوان عليها في شكل أفعال إجرامية تختلف شدتها وخطورتها بحسب طبيعة العقوبات المقررة عليها فالتشريع الإسلامي قسمها إلى جرائم الحدود؛ القصاص؛ التعزير، وحدد العقوبات المقررة لها ، وبين الآثار المترتبة على هذا التقسيم وأهميته، والمشرع الجزائري بدوره تبنى التقسيم الثلاثي للجرائم جناية؛ جنحة، مخالفة بموجب المادة 27 من قانون العقوبات وحدد العقوبات المقررة لكل تقسيم بحسب خطورته الإجرامية بموجب المادة 5 من قانون العقوبات كما يترتب على هذا التقسيم أثار جوهرية لها أهمية من حيث صلاحية الاختصاص ، والتحقيق والشروع ، والمساهمة الجنائية. The human tendency inherent in the human being is always looking for well-being and stability, but it collides with the system of social repression, the most important of which is the law because it is linked to penalties affecting freedom and physical safety in the event that the interests worthy of protection are threatened by aggression in the form of criminal acts whose severity and gravity vary according to the nature of the penalties imposed on them. Islamic divided it into hudud crimes,; retribution; Punishment, and defined the penalties prescribed for it, and explained the implications of this division and its importance. The Algerian legislator, in turn, adopted the tripartite division of crimes as a felony; A misdemeanor, a violation according to Article 27 of the Penal Code and defined the penalties for each division according to its criminal gravity in accordance with Article 5 of the Penal Code.
