أحكام جريمة إساءة استغلال الوظيفة في التشريع الجزائري

Résumé: اتجه المشرع الجزائري إلى تجريم كل مساس بنزاهة الوظيفة العامة سعيا منه في مواجهة كل إخلال بالقوانين والتنظيمات الوظيفية المعمول بها من خلال استحداثه جريمة إساءة استغلال الوظيفة العامة بنص قانوني خاص لما فيه من تنامي لهذه الظاهرة في الإدارات العمومية وحفاظا على صورة الموظف العمومي وسمعته، وباعتبارها من جرائم الفساد الخطيرة وذو أثار سلبية تحطم الاستقرار داخل الدولة ومؤسساتها، سعت مختلف التنظيمات والتشريعات الدولية والوطنية على حد سواء في بذل مجهود كبير من خلال نصوص تشريعية تنص على أساليب تحري خاصة لقمعها وتقرير عقوبات لمكافحتها. الكلمات المفتاحية: استغلال - الوظيفة – الموظف - أساليب التحري الخاصة. Abstract: Summary the Algerian legislator tended to criminalize every violation of the integrity of the puplic office in an effort to confront every breach of the laws and functional reglations in force by introducing the crime of abuse of the public office with a special legal provision because of the growth of this phenomenon in public administrations and to preserve the image and reputation of the public employee and as a serious corruption crime with negative effects that shatters stability withthe state and its Institutions ,various international and national organizations and legislations have sought to makea greateffort through legislative texts that stipulate special investigation methods to suppress it and decide penalties to combat it.
