اشكالات تجريم اساءة استغلال الوظيفة في التشريع الجزائري

Résumé: الملخص: مجابهة للإخلال بالتشريعات والتنظيمات الوظيفية، عمد المشرع الجزائري إلى تجريم كل مساس بالنزاهة والأمانة الوظيفية، حيث اصبغ وصف التجريم على قيام الموظف العام بعمل أو الامتناع عنه على نحو يخرق القوانين والتنظيمات، في إطار ممارسته الوظيفية، وبغرض الحصول على منافع غير مستحقة، أيا كان المستفيد منها، سواء كان الموظف العام شخصيا أو غيره طبيعيا كان أو معنويا. غير أن إصباغ وصف التجريم على إساءة استغلال الوظيفة وان كان يتسم بشمولية واتساع رؤيتها القانونية، قد صاحبه بعض الغموض شكل وبحق، إشكالات قانونية ارتبطت من جهة بشمولية السياق العام للتجريم، وبقصوره من جهة أخرى. Abstract: In response to violations of legislation and functional regulations, the Algerian legislature has criminalized any prejudice to integrity, The description of criminalization is characterized as an act or omission of public official in a manner that violates the law, In the context of its functional practice and for the purpose of obtaining undue benefits, whatever the beneficiary, Whether the public official is personal or otherwise normal or moral. However, while the characterization of criminalization is comprehensive and legal, it is not easy, It’s been accompanied by some mystery, Legal problems linked, on the one hand, to the universality of the general context of criminalization and, on the other, to its limitations.
