أيُ استقلالية للهيئة الوطنية للوقاية من الفساد ومكافحته في القانون الجزائري ؟

Résumé: تضمن التعديل الدستوري لسنة 2016 باعتباره أسمى قانون في الدولة عدة مؤسسات فاعلة في مجالات مختلفة. تعد الهيئة الوطنية للوقاية من الفساد ومكافحته إحدى أهم هذه المؤسسات نظرا لتفشي الفساد ولما يساور الدولة من قلق إزاء ما يثيره من مخاطر على أمن واستقرار البلاد. وعليه فالغاية من هذه الدراسة الوقوف عند الأحكام المنظمة للهيئة للوصول إلى مدى توفيق المشرع في جعلها هيئة مستقلة فاعلة في مجال الوقاية من الفساد ومكافحته تستجيب للأحكام المنشئة لها، الأمر الذي يقتضي منا البحث في مدى تجسيد معالم استقلاليتها من الناحية العضوية والوظيفية معتمدين في ذلك على المنهج التحليلي للنصوص التي جاء بها المشرع في هذا المجال. Abstract: The constitutional amendment of 2016 as the highest law in the country included several active institutions in various fields. One of the most important of these institutions is the National Authority for Prevention and Control of Corruption, due to the widespread corruption and the state's concern about the risks it poses to the security and stability of the country. Accordingly, the purpose of this study is to stand at the rulings regulating the authority in order to reach the extent of the legislator’s success in making it an independent and effective body in the field of preventing and combating corruption that responds to the provisions established for it, which requires us to research the extent of embodiment of its independence and functional independence aspects, relying in this approach Analytical texts brought by the legislator in this field.
