Résumé: The housing is the main concern of the citizens at this time. Thus, the government has launched great effort to face this problem due to the increasing of protests and the large deficit in the field. So, the Ministry of housing as ,a representative of the state, has created many formats and announced that in the six (6) years past it will provide about one million houses using all the formulas. And in front of this huge need for houses that will be completed in record time number, it will have to tighten the control over the construction work and who have been determining the responsibility of all intervening parties in the process of providing those needs. What concerns us in this research is the responsibility of promoters, the contractor and the architect and all intervening in the construction process, and this leads us to ask the following problem: What is the effectiveness of this system to rule the participants in the construction? We have had this probleme and we got that this system is still weak to protect the owners.
