أسلوب التسرب في القانون الجزائري

Résumé: تطور الإجرام و تطورت معه أساليب البحث و التحري ، و من بين الأساليب الجديدة في البحث و التحري نجد أسلوب التسرب ، الذي نظم المشرع الجزائري أحكامه في قانون الإجراءات الجزائية من المادة 65 مكرر 11 إلى المادة 65 مكرر 18 ، و نظرا لأهمية هذا الأسلوب التي تكمن في حداثته و فعاليته في كشف الجرائم و المجرمين ، و نظرا كذلك إلى خطورته و صعوبات تطبيقه ، ارتأينا أن يكون أسلوب التسرب موضوع دراستنا ، حيث سنقوم بدراسة مفهوم التسرب من خلال دراسة تعريفه اللغوي و الاصطلاحي و الفقهي و القانوني ، و دراسة صوره ، و سنقوم كذلك بدراسة أحكام التسرب من خلال دراسة شروط تطبيق التسرب ، و دراسة الحماية القانونية للمتسرب . Criminality has evolved, and methods of research and investigation have evolved, and among the new methods of research and investigation we find the leakage method, which is organized by Algerian legislature in the Code of Criminal Procedure from Article 65 repeater 11 to Article 65 repeater 18 , Due to the importance of this method, which lies in its modernity and effectiveness in detecting crimes and criminals, and due to its dangerousness and difficulty in applying this method, we see us that the leakage method will be the subject of our study, where we will study the concept of leaking through its linguistic definition and legal definition and jurisprudence definition , and we studies of its types , and we studies the legal provisions of leakage through a study of the conditions of leakage and legal protection of the tractor.
