فعالية دور السلطة الوطنية لحماية المعطيات الشخصية في البيئة الرقمية

Résumé: أصدر المشرع الجزائري مجموعة من القوانين بغرض حماية خصوصية الأفراد، ومن بينها القانون18-07 المتعلق بحماية المعطيات الشخصية في مجال المعالجة من خلال وضع قواعد وآليات مؤسساتية تتمثل في السلطة الوطنية، ونظمها عضوياً ووظيفياً بشكل يضمن ويعزز دورها في حماية المعطيات الشخصية خلال ممارسة المعالجة الآلية. كما أقر المشرع جزاءات إدارية وجزائية بشكل يضمن عدم المساس بالحياة الخاصة، لكل مسؤول عن المعالجة في حالة الإخلال بالإلتزامات المنصوص عليها قانوناً، والمساس بحقوق الشخص الطبيعي. The Algerian legislator issued a set of laws with the aim of protecting the privacy of individuals, including Law 18-07 related to the protection of personal data in the field of processing by setting rules and institutional mechanisms represented in the National Authority, and organizing them organically and functionally in a way that guarantees and enhances its role in protecting personal data during the practice of automated processing. The legislator also approved administrative and penal sanctions in a manner that ensures that the private life of each person responsible for the treatment is not infringed, in case of breach of the obligations stipulated by law, and the violation of the rights of the natural person.
