الحماية الإدارية والجزائية في مجال معالجة المعطيات ذات الطابع الشخصي على ضوء القانون18-07

Résumé: يعتبر القانون 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي قفزة نوعية بخصوص حماية المعطيات الشخصية في البيئة الرقمية، فهو يحدد القواعد والمبادئ الأساسية، إضافة إلى الأحكام الإدارية والجزائية. يهدف هذا البحث إلى معرفة مدى فاعلية أحكام القانون18-07 في مجال معالجة المعطيات ذات الطابع الشخصي، حيث استخدمنا المنهج التحليلي بهدف فهم نصوصه، كما استعملنا المنهج المقارن كلما دعت الحاجة لذلك، وخلصنا إلى ضرورة وجود بنية تحية قوية لشبكة الانترنت بما يسمح بتطبيق أحكام هذا القانون بالنسبة لمختلف المتدخلين في هذا المجال، واعتبار السلطة الوطنية لحماية المعطيات ذات الطابع الشخصي آلية فعالة تضمن مطابقة معالجة المعطيات ذات الطابع الشخصي لأحكام هذا القانون، ضمانا لعدم المساس بحرمة الحياة الخاصة للأفراد. Abstract: The Act 18-07 on the protection of naturel persons in the processing of personal data is a qualitative leap in the digital environment; it also sets out the provisions and the fundamentals principles in addition to administrative and penal provisions. This research is aimed at how effective are the provisions of the act 18-07 in the field of processing of personal data and that's using the analytical approach in a view understanding the provisions of The act 18-07 and some relevant laws , we also used the comparative approach whenever necessary and we recover of considering that the national authority for the protection of personal data as an effectiveness mechanism which ensures match processing the personal data in accordance to all provisions of this act , ensuring to not compromis the inviolability of the private life of individuals.
