ضمانات حماية المعطيات الشخصية في البيئة الرقمية في التشريع الجزائري

Résumé: أقر المشرع الجزائري من خلال قانون حماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، جملة من المقتضيات و التدابير القانونية الهادفة إلى ضمان حماية الحق في الخصوصية ، و لاسيما في البيئة الرقمية التي تعرف تطورا علميا وتكنولوجيا متزايدين ، يزداد معهما خطر انتهاك هذا الحق. ومن أهمها ضبط المفاهيم القانونية لمختلف الفاعلين بمجال المعطيات الشخصية، وتحديد المبادئ الأساسية لحماية هذه المعطيات ، مع استحداث سلطة وطنية لحماية المعطيات ذات الطابع الشخصي، وكذا تحديد حقوق الشخص المعني بالمعالجة و التزامات المسؤول عنها، بالإضافة إلى تجريم الانتهاكات الواقعة على نظام المعطيات الشخصية. حيث تتعرض هذه الدراسة لمدى فعالية هذه الضمانات القانونية في حماية المعطيات الشخصية في البيئة الرقمية ، بدراسة كل ضمان و تقييمه. The Algerian legislator, through the Law on the Protection of Natural Persons in the field of handling data of a personal nature, has established a set of legal requirements aimed at ensuring the protection of the right to privacy, especially in the digital environment that is experiencing increasing technological and scientific development, with which the risk of violating this right increases. Among the most important ones are controlling the legal concepts of the various actors in the field of personal data, creating a national authority to protect data of a personal nature, defining the rights of the person concerned with the treatment and the obligations of the person responsible for it, in addition to criminalizing violations that occur on the personal data system. This study examines the effectiveness of these legal guarantees in protecting personal data in the digital environment, by examining and evaluating each guarantee.
