Résumé: الملخص: نهدف من خلال هذه الدراسة الى محاولة تسليط الضوء على نظام الامر الجزائي وأثره على حقوق الدفاع, والذي تبناه المشرع الجزائري في تعديله الأخير لقانون الإجراءات الجزائية، بهدف تخفيف العبء عن القضاء والإسهام في التخفيف من كم القضايا المعروضة عليه, وتبسيط الإجراءات واختصارها، والتقليل من الجهد والنفقات، سواء أكان ذلك بالنسبة للخصوم أو جهاز العدالة. إن ما يميز نظام الأمر الجزائي أنه وسيلة لإدانة المتهم دون محاكمة، ولعل ذلك ما له تأثير كبير على العديد من المبادئ الجنائية المستقرة في قواعد العدالة الجنائية، سواء تلك المتعلقة بإجراءات المحاكمة العادلة ذاتها، أو تلك التي تمس بالضمانات المقررة للمتهم، ولعل أهمها: مبدأ الوجاهية والحق في الدفاع وعلنية الجلسات. Abstract: Through this study we aim to highlight in the last amendment of the criminal procedure code, and in order to lighten the criminal justice, the Algerian legislator adopted criminal injunction as a substitute for public action. Criminal injunction is a means for indictment without judgment; it is not free of danger, In addition, Due to the fact that the criminal injunction affects the guarantees of an equitable trial. It is able to shake the very foundation of the basic principles in criminal matters, or those that affect the guarantees established, and perhaps the most important: the principle of prestige, the right of defense, public hearings.
