الإثبات في الكتابة الالكترونية

Résumé: إن التطور التكنولوجي الحاصل في شتى أنحاء المعمورة، ووجود ثورة علمية في نقل المعلومات عبر الأنظمة الالكترونية ، يعود إلى تغير مفهوم الإثبات ، لما ترتب عليه من نشوء حقوق والتزامات الكترونية ، مما يؤدي بنا إلى إثبات هاته التعاملات الالكترونية ، لأن غالبية التعاملات تتم اليوم عن طريق مجال المعلوماتية، لأن الانترنت أصبحت توفر السهولة في التعامل ، ويعتبر المحرر الالكتروني أداة لإثبات هاته المعاملات عن طريق الكتابة الالكترونية ، والإشكال الحاصل اليوم هو مدى حجية المحرر الالكتروني ، وخاصة في حال نشوء نزاع بين المحرر الالكتروني والمحرر العرفي ، إلى أيهما تكون الحجة أقوى وخاصة بالنسبة للقاضي . The technological development around the globe and the scientific revolution in the transmission of information across electronic systems have changed the concept of proof, with the resulting creation of electronic rights and obligations, leading us to prove electronic transactions. The most common transactions are now conducted through the field of informatics because the Internet has become easy to deal with, and the electronic editor is a tool to prove these transactions by electronic writing, and the forms that are now being produced are the extent of the electronic editor's problem, especially in case of a dispute between the electronic editor and the customary editor. Which argument is stronger, especially for the judge, who in turn falls into forms of proof, a real puzzle.
