شركة المساهمة البسيطة : بين الحفاظ على الطابع المالي وتعزيز الإعتبار الشخصـي (دراسة مقارنة)

Résumé: مما لاشك فيه أن للإقتصاد دور كبير في تنمية الدول وإزدهارها، بحيث حرصت ودأبت الدول النامية والمتقدمـة على حد سواء إلى تنويع المشروعات الإقتصادية، مستخدمة في سبيل ذلك أدوات وأساليب عديدة ولعل أن المؤسسات الناشئة هي احدى أدوات وآليات محركات النمو الاقتصادي للدول، والتي تمثل عصب الإقتصاد المحلي والدولي، وحرصا من المشرع الجزائري على دعم هذا النوع من المؤسسات، استحدث شكلاً جديدا للشركات التجارية ليتناسب معه بموجب القانون رقم 22-09، وهي شركة المساهمة البسيطة، والتي أجمع فيها المشرع بين الحفاظ على مقتضيات الطابع المالي وتعزيز الإعتبار الشخصي. There is no doubt that the economy has a major role in the development and prosperity of countries, so that developing and developed countries alike have been keen and persistent to diversify economic projects, using many tools and methods for this. Being the backbone of the local and international economy, and in the interest of the Algerian legislator to support this type of institution, he created a new form of commercial companies to suit him under Law No. 22-09, which is a simple joint stock company, in which the legislator combined the preservation of the requirements of the financial nature and the promotion of personal consideration.
