جريمة التعدي على الأملاك العقارية العامة في التشريع الجزائري

Résumé: استهدفت هذه الدراسة الحماية الجزائية للأملاك العقارية العامة حيث أقر المشرع عديد النصوص التي تهدف لحماية العقار من كل أنواع التعدي وإذا كان مسعاه من خلال المادة 386 من قانون العقوبات والتي تعتبر المبدأ العام الذي تستند إليه مختلف الجرائم الواقعة من العقار والسياج العام وحددت ركنها المادي في انتزاع عقار مملوك للغير عن طريق الخلسة وبطرق التدليس، كما ربط المشرع في المادة 386 فعل الانتزاع باتباع الخلسة والتدليس التي يصعب تصورها في الاستلاء على العقار على عكس المنقول، وكذلك بموجب قانون الأوقاف رقم 91-10 المعدل والمتمم، وهذا بهدف ردع كل من تسوّل له نفسه المساس بهذه الأملاك الوقفية، غير أنه لتقرير الحماية الجزائية يجب توافر الأركان العامة للجريمة، والأركان الخاصة بجريمة التعدي على الملكية الوقفية بشكل خاص. الكلمات المفتاحية: الملكية العامة، الوقف، العقار، الأملاك العقارية. abstract: This study aimed at the penal protection of public property.
