تسوية البناء الفوضوي في ظل القانون رقم: 08-15

Résumé: يعد البناء رمز استقرار الإنسان في حياته ونقطة للانطلاق في نشاطه اليومي لذلك يستوجب احترام النظام القانوني الخاص بالتعمير عموما وبرخصة البناء خصوصا، لأن أي خلل أو قصور في البناء سيؤدي بالضرورة إلى العديد من الحوادث التي تمس سلامة الأفراد ومن ثمة تعريض أرواحهم للعديد من المخاطر. إن الواقع يشهد انتشار البنايات الفوضوية التي استفحلت الأراضي الفلاحية والمناطق الأثرية والتي بدورها أثرت على البيئة وقضت على الطابع الجمالي والذوق الهندسي للبناية، مما دفع بالمشرع الجزائري إلى إصدار القانون رقم 08-15 يحدد قواعد مطابقة البنايات وإتمام إنجازها قصد تسوية مثل هاته البنايات التي أثرت سلبا على البيئة. على الرغم من النصوص القانونية المنظمة للعمران في الجزائر وعلى الرغم من استصدار القانون رقم 08-15 إلا أن الواقع أثبت عدم كفاية المدة من جهة وجهل المواطنين لمضمون قانون التسوية وتمردهم من جهة ثانية. Construction is a symbol of human stability in one's life and a starting point in one's daily activity. It is therefore necessary to respect the legal system of reconstruction in general and the building permit in particular, because any defect or failure in the construction will necessarily lead to many accidents that compromise the safety of people and expose their lives to many risks. Reality is witnessing the spread of shanty construction that have exacerbated agricultural land and archaeological areas, which has had an impact on the environment and eliminated the aesthetic and technical taste of the building, prompting the Algerian legislator to promulgate Law No. 08-15 defining the rules of conformity and completion of buildings in order to locate affected buildings On the environment. Despite the legal texts governing urban planning in Algeria and despite the enactment of Law No. 08-15, the reality proved to be insufficient and lack of knowledge of the content of the law of settlement and its rebellion citizens.
