الاستخدام غير المشروع لبطاقة الدفع الالكتروني وأحكام المسؤولية عن الفعل الشخصي

Résumé: نتيجة للثورة المعلوماتية التي اجتاحت العالم مست جميع القطاعات وفي شتى الميادين بما في ذلك المعاملات التجارية من خلال ما يعرف بالتجارة الالكترونية ( ) فإن القطاع البنكي لم يكن بمنأى من هذه الثورة لا سيما أنه ذو بعد مزدوج اقتصادي-قانوني، فتطور المنظومة البنكية وتيسير الحصول على القروض وسهولة التعاملات المالية المختلفة من دفع وسحب واقتطاع ومقاصة من شأنه أن يؤثر إيجابا على اقتصاد الدولة نظرا للارتباط الوثيق بينهما. غير أن تطور وتقدم قطاع البنوك عن طريق رقمنته وربطه بالتكنولوجيات الحديثة مرهون بوجود فضاء قانوني مناسب وملاءم ينظم مختلف التعاملات البنكية بالقدر الذي يجعل المنظومة التشريعية للبلاد مسايرة للتطورات التكنولوجية، عن طريق الاعتراف بوسائل الدفع الحديثة كأدوات لوفاء المدين بالتزاماته المالية في مواجهة دائنه وإحاطتها بضمانات قانونية وتقنية تطمئن الأشخاص وتجعلهم يثقون في التعامل الالكتروني عن طريق بطاقات الدفع. As a result of the information revolution that engulfed the world, it touched all sectors and in various fields, including commercial transactions through what is known as electronic commerce. Loans and ease of various financial transactions of payment, withdrawal, withholding and clearing would positively affect the state economy due to their close association. However, the development and advancement of the banking sector by digitizing it and linking it with modern technologies is subject to the existence of a suitable and appropriate legal space that regulates the various banking transactions to the extent that the legislative system of the country is in line with technological developments, by recognizing modern means of payment as tools for the fulfillment of financial obligations of the debtor in the face of its creditor and surrounded by legal and technical guarantees
