دور القاضي الوطني كمراقب للحكم التحكيمي

Résumé: أما فيما يخص أسباب بطلان حكم التحكيم الدولي ينصح بإدراج حالة فصل هيئة التحكيم خطا باختصاصها أو عدم اختصاصها، وذلك لتغطية الحالات الثلاثة الواردة ضمن السبب الاول من المادة 1056 وايضا حالة فصل هذه الهيئة بعدم اختصاصها رغم اتفاق التحكيم. - أغفل المشرع التطرق لأثار البت بنظر الطعن ببطلان حكم التحكيم الدولي واكتفى بالحديث عن أثار رفع هذه الدعوى، وفي هذا الصدد ينصح بأن يمنح للقاضي سلطة تقديرية في تقرير وقف تنفيذ حكم التحكيم الدولي لكي لا تصبح دعوى البطلان وسيلة سهلة في يد سيئ النية لعرقلة التحكيم. وفي ختام هذا البحث نتمنى اننا اعطيناه حقه كما ينبغي، لكن حسب ما اننا قدمنا كل ما في وسعنا من بذل مجهود قصد الوصول به الى هذه الصورة والتي نسال الله ان تكون مقبولة. ith regard to the reasons for the invalidity of the international arbitration award, it is recommended that the case of the dismissal of the arbitral tribunal be included in its jurisdiction or non-jurisdiction, in order to cover the three cases included in the first reason of article 1056. In this regard, it is recommended that the judge be granted discretionary power in the determination of the suspension of the implementation of the international arbitration award so that the nullification case does not become an easy means in the bad faith hand to obstruct the arbitration. At the conclusion of this research, we hope that we have given it its right as it should, but as we have done everything in our power to make an effort to reach it in this picture, which we ask God to be acceptable.
