مجلس المنافسة كآلية للقضاء على المضاربة غير مشروعة

Résumé: تهدف هذه الدراسة الى تناول مجلس المنافسة كآلية للقضاء على المضاربة غير المشروعة، بحيث يعتبر مجلس المنافسة الهيئة الضابطة للمنافسة الحرة والنزيهة في السوق، وهو ما يستشفي من الامر رقم 03-03 المتعلق بالمنافسة المعدل والمتمم، وفي هذا الصدد فلقد اسندت اليه مجموعة من الاصلاحات للقضاء على كل ما يعرقل قيام منافسة فعليه في السوق، خصوصا الممارسات المقيدة للمنافسة وايضا في الترخيص بالتجمعات الاقتصادية. وفي إطار مكافحته وتصديه للممارسات المقيدة للمنافسة، فانه ايضا يساهم في محاربة ومكافحة المضاربة غير المشروعة التي جرمها القانون رقم 21-15 المتعلق بمكافحة المضاربة غير المشروعة، وذلك بطريقة غير مباشرة وهو ما سنوضحه من خلال هذه الدراسة. The aim of this study is to examine the Competition Council as a mechanism for combating insider trading, where the Competition Council is considered the regulatory authority for free and fair competition in the market, as stipulated in Order No. 03-03 related to amended and complementary competition, and in this regard, it has been assigned a range of reforms to eliminate all obstacles to effective competition in the market, especially practices that restrict competition and in licensing economic mergers. In the context of combating and addressing practices that restrict competition, it also contributes to the fight against insider trading, which is criminalized by Law No. 21-15 on combating insider trading, indirectly, and this will be explained through this study.
