حماية الأقليات المسلمة في ميانمار من جريمة الإبادة الجماعية بفرض الجوع - بين المحكمة الجنائية الدولية ومحكمة العدل الدولية-

Résumé: تعرضت الأقليات المسلمة في العالم بصفة عامة و في ميانمار بصفة خاصة إلى الاعتداء على كافة حقوقها الإنسانية، من الحق في الحياة إلى الحق في تقرير المصير والحق في الكرامة الإنسانية، وتم الاعتداء على الكثير من حقوقها الاجتماعية، الاقتصاية والثقافية ومنها الحق في الغذاء، عن طريق تعريض تلك الشعوب إلى الموت جوعا أو نهب أراضيهم أو إجبارهم على النزوح أو اللجوع دون الحصول على الموارد الأساسية للعيش، وغيرها من الأساليب التي تصل إلى حد أن تكون جرائم دولية يجب معاقبة مرتكبيها، وأمام غياب توازن القوى على المستوى العالمي والصمت الدولي بشأن حقوق تلك الفئة، نجد جريمة مثل جريمة الإبادة بفرض الجوع لا يتم الاهتمام بها أو محاسة مرتكبيها، وشعوب الرهينغا قد تعرضوا، ومازالوا يعانون، من استخدام أساليب تتنافى والمبادئ الإنسانية مثل استخدام التجويع ضدهم وانتهاك مختلف حقوقهم الإنسانية. Abstract: Muslim minorities in the world ,in Myanmar particular, have been subjected to attacks on all their human rights, from the right to life to the right to self-determination and the right to human dignity, and many of their social, economic and cultural rights, including the right to food, have been attacked through Exposing those peoples to starvation, plundering their lands, or forcing them to flee or starve without obtaining basic resources for subsistence, and other methods that amount to international crimes whose perpetrators must be punished, and in the face of the absence of a balance of power at the global level and international silence regarding the rights of that group. We find a crime such as the crime of genocide by imposing starvation that is not paid attention to or the perpetrators are imprisoned, and the Rohingya people have been subjected, and are still suffering, from the use of methods that are inconsistent with human principles such as the use of starvation against them and the violation of their various human rights.
