أثر التطور التكنولوجي على تكوين المعاملات Impact Of Technological Development On Transaction Formation

Résumé: إن التقدم العلمي والتكنولوجي في العصر الحديث وإن كان يفتح آفاقاً ضخمةً أمام تقدم البشرية وتحقيق مستوى أفضل من الحياة، إلا أنه يحمل بين طياته في نفس الوقت مخاطر ضخمة تهدد قيم وحقوق وحريات وأمن الأفراد والجماعات والدول، لذا بدت الحاجة الماسة لمواجهة تلك المخاطر والتغيرات, ولعل أول التطلعات في هذا المجال كانت نحو القانون الذي يُعد من أقدس مهامه وضع الصيغ الملائمة للأفراد، ومن هنا كانت أهمية وجود الضوابط القانونية التي يعمل في إطارها التطور التكنولوجي. وقبل أن نوضح الضوابط القانونية كان لابد أن نلقي الضوء على توضيح تكوين المعاملات وتأثيرها من التطور التكنولوجي، وهل سيواكب القانون التطور التكنولوجي السريع من خلال إصدار أحكام ونصوص قانونية تحمي الفرد والمؤسسات أم لا؟ الكلمات المفتاحية: الضوابط القانونية، التكنولوجيا، المعاملات، العقد الإلكتروني, التقدم العلمي. Abstract: The scientific and technological progress in the modern era, although it opens huge horizons for the progress of mankind and the achievement of a better standard of life, but it carries with it at the same time huge risks that threaten the values, rights, freedoms and security of individuals, groups and countries. The first aspirations in this field were towards the law, which is considered one of its most sacred tasks, laying down appropriate formulas for individuals; hence the importance of the existence of legal controls within which technological development operates. Before we clarify the legal controls, it was necessary to shed light on clarifying the formation of transactions and their impact on technological development, and will the law keep pace with rapid technological development through the issuance of legal provisions and texts that protect the individual and institutions or not? keywords: legal controls, technology, transactions, electronic contract, Scientific progress.
