تنظيم القضاء الدستوري في التجربتين الجزائرية و المغربية تشابه في الأسماء أم الفعالية.

Résumé: ملخص : لتنظيم القضاء الدستوري في الجزائر و المغرب أثر على فعاليته، حيث أنه لطبيعة القضاء الدستوري و مكانته في المنظومة الدستورية بالغ الأهمية فقد اعتبر المجلس الدستوري الجزائري كهيئة مستقلة جهاز القضاء الدستوري إلى غاية التعديل الدستوري 2016 الذي اعتبرت تشكيلته سياسية محضا مما أثر على عمله و استقلاليته، وبالتعديل الدستوري لسنة 2020 تبنى المؤسس الدستوري المحكمة الدستورية كهيئة مستقلة عن أي سلطة التي تعتبر انتقالة نوعية في القضاء الدستوري بتشكيلة تضمن نوعا ما استقلاليتها، أما في المغرب فقد تبنى المؤسس الدستوري المجلس الدستوري كهيئة مستقلة، لكن شانه شأن سابقه في الجزائر بتشكيلة سياسية محضة، ثم تبنى المحكمة الدستورية بتشكلية سياسية محضة تؤثر على استقلاليتها و بالتالي على عمليتها و فعاليتها في دولة القانون. Abstract: Organizing the constitutional judiciary in Algeria and Morocco has affected its effectiveness, as the nature of the constitutional judiciary and its position in the constitutional system is extremely important. The Algerian Constitutional Council considered as an independent body the constitutional judiciary until the constitutional amendment of 2016, whose formation was considered purely political, which affected its work and His independence, and with the constitutional amendment of 2020, the constitutional founder adopted the Constitutional Court as an independent body from any authority that is considered a qualitative transition in the constitutional judiciary with a formation that somewhat guarantees its independence In Morocco, the constitutional founder adopted the Constitutional Council as an independent body, but it was the same as its predecessor in Algeria with a purely political formation, then the Constitutional Court was adopted with a purely political formation that affects its independence and thus its operation and effectiveness in the rule of law.
