إمكانية حل النزاع البحري الجزائري الاسباني بين الاعتبارات القانونية الواردة في اتفاقية قانون البحار لسنة 1982 والتعقيدات العملية.

Résumé: تعتبر الوسائل السلمية لفض المنازعات البحرية الدولية الحل الأنسب الذي اهتدى إليه المجتمع الدولي وأسس لها ضمن اتفاقية قانون البحار لسنة 1982، والتي تضمنت نظاما قانونيا متطورا لتسويتها، كونه يحمل شقا فنيا وتقنيا.ومن أهم هذه المنازعات نجد تلك المتعلقة بعملية تحديد المنطقة الاقتصادية الخالصة بين الدول ذات السواحل المتقابلة والمتجاورة، فهذا التحديد يتصل بتنفيذ مختلف الأنشطة الاستكشافية والاستغلالية للموارد الحية وغير الحية. وكمثال على هذه النزاعات نجد بوادر النزاع الجزائري الإسباني، هذا النزاع يستدعي إيجاد حلول تسمح بإمكانية اقتراح حلول لفضه وفقا لاتفاقية قانون البحار، وذلك حتى يتجنب المجتمع الدولي تطور مضمون النزاع، وخاصة المحور الإقليمي للبحر المتوسط. *Abstract: Peaceful means of resolving international maritime disputes are considered the most appropriate solution that the international community found and established within the framework of the 1982 Law of the Sea Convention, which included an advanced legal system to settle them, because it has a technical and artistic aspect. Among the most important of these disputes are those related to the process of determining the exclusive economic zone between countries on opposite and adjacent coasts, this determination is linked to the implementation of various exploration and exploitation activities of living and non-living resources. As an example of these conflicts we find the signs of the Algerian-Spanish conflict. This conflict requires finding solutions that make it possible to propose solutions to resolve it in accordance with the Convention on the Law of the Sea, so that the international community avoids the development of the content of the conflict, in particular the regional axis of the Mediterranean.
