نظــــام التعاقد في الوظيفة العمـــومية

Résumé: The systems of the civil service differ in the world. Each country selects a system that is in line with its political, economic and social orientations. And Algeria, after its independence and establishment as a stand-alone state, we find that it adopted the closed system for public office in the form of research as an imperative and not an option for political considerations similar to all of its legal system until the issuance of the order 66-133, which included the contracting system as one of the forms of an open system and considered it a mechanism for employment in public administrations and institutions. The implementation of the ordinance 06-03, which maintained the contracting system through other work systems that are embodied in cases of preservation, maintenance and service activities, or to warn work of experience or study, or in the place of positions designated for employees as an exception, and upon signing the contract, the contractor acquires the rights and duties contained in the decree Presidential 07-308, and in the event that he commits professional mistakes, he is subject to the disciplinary system stipulated in Article 60 of the aforementioned decree, and the matter may, in case of the severity of the mistake, reach the termination of the contract.
