الانحياز للقانون الوطني من خلال المفاضلة بين الجنسية والموطن في تنازع قوانين الأحوال الشخصية

Résumé: رغم اتفاق التشريعات على أن القانون الشخصي هو الذي يحكم التنازع المكاني لقوانين الأحول الشخصية، إلا أنها سرعان ما تختلف بشأن تحديد الضابط المفضل بين الجنسية والموطن، حيث الانحياز لأحدهما، أو التوفيق بينهما، يتوقف على السياسات والمقاربات التشريعية المنتهجة، بما يحقق حماية أشمل للمصالح الوطنية والرعايا الوطنيين من جهة، ويراعي للحياة الدولية الخاصة من جهة أخرى. Although the legislation agrees that the personal law is the one that governs the spatial conflict of personal status laws, it quickly differs regarding determining the preferred connecting factors between nationality and domicile, where bias to one of them, or reconciliation between them, depends on the Politics and legislative approaches adopted, in order to achieve a more comprehensive protection of interests National and national subjects on the one hand, and take into account the private international life on the other hand.
