Résumé: بتأسيس الشركة وفقا للشكل المختار، تباشر مختلف معاملاتها وتصرفاتها وفقا للهدف الذي تأسست من أجلـه، إلا أن هذا الشكل والنظام غير مقيدة به أبـدياً ولا رجعة فيـه، بل يسمح القانون للشركة أثناء حياتها أن تعدل هذا الإختيار وتتحول إلى شكل آخر، وقد يلزم القانون الشركة بالتحول إلى شكل معين أو يمنح لها فرصة الإختيار في ظروف وشروط معينة، وهي في ذلك إما أن تصعد أو تنزل في سلم أشكال الشركات التجاريـــة. تعد عملية تحول الشركات التجارية الأداة القانونية لتغيير شكل ونظام الشركة لأحد الأشكال على اختلاف أنواعها، بحيث يهدف إلى تحقيق الأهداف التي تواجه التطور السريع والمتلاحق في مجال الشركات التجاريـة، كما هو الحال في ظهور وبروز أشكال جديدة للشركات والكيانات التجارية والإقتصادية مما يعول عليه كأداة وآلية لتشجيع الإنتقال إليها.
