Résumé: الملخص : تعتبر الحقوق والحريات أحد أهم مرتكزات الدولة القانونية وأي انتقاص من هذه الحقوق يؤدي حتما إلى الإخلال بمبدأ إرساء دولة القانون وإذا كانت الدول تحرص على تكريس الحقوق والحريات ضمن دساتيرها ، إلا ان ممارستها في الظروف العادية تختلف عن ممارستها في الظروف الاستنائية حيث تكون مقيدة في الظروف الاستثنائية بمشروعية الأزمات ولقد عرفت دول العالم مؤخرا ظروف صحية فرضها انتشار فيروس كورونا أو كوفيد 19 ، مما دفع بهذه الدول ومنها الجزائر والمغرب إلى فرض تدابير استثنائية ،وعليه لا بد من معرفة هذه التدابير الاستثنائية ، وأثرها على الحقوق والحريات وإرساء دولة القانون . الكلمات المفتاحية: الحقوق ، الحريات، ، الظروف الاستثنائية الصحية ; دولة القانون Abstract : Rights and freedoms are considered one of the most important pillars of the state of law and any deficiency in these rights leads to the violation of the principle of establishing the state of law and if states are keen to enshrine rights and freedoms within their constitutions, but their practice in normal circumstances is different from their practice in exceptional circumstances, where they are restricted in exceptional circumstances by the legitimacy of crises. most countries of the world have recently witnessed exceptional health conditions imposed by the spread of Corona virus covid 19 this later leads those countries such as Algeria and Morocco to impose some exceptional measures.
