The High Authority For Transparency, Prevention And Fight Against Corruption In Light Of 2020 Constitution Amendment (an Analytical Legal Study Of Its Structure And Powers)

Résumé: Following the 2020 constitutional amendment, Algeria's constitutional creator formed the High Authority for Transparency, Prevention, and Fight against Corruption to replace the National Authority for the Prevention and Fight Against Corruption. The aforementioned authority was elevated to the status of an independent constitutional institution, and its role was strengthened by Law No.22-08, which specified its structure and powers, with the legislator aiming to broaden its composition and grant it broad supervisory powers in order to achieve the highest levels of integrity and transparency in public affairs administration. في إطار سياسة الوقاية من الفساد ومكافحته، استحدث المؤسس الدستوري الجزائري بموجب التعديل الدستوري لسنة 2020 مؤسسة جديدة كآلية للوقاية من الفساد، تحت تسمية السلطة العليا للشفافية والوقاية من الفساد ومكافحته لتحل محل الهيئة الوطنية للوقاية من الفساد ومكافحته. ولقد منحها مكانة أكثر أهمية بجعلها مؤسسة دستورية مستقلة، وعزز دورها من خلال القانون رقم 22-08 المحدد لتشكيل وصلاحيات هذه السلطة، الذي سعى من خلاله المشرع إلى توسيع تشكيلتها وتزويدها بصلاحيات رقابية واسعة، والتي من شأنها تحقيق أعلى مؤشرات النزاهة والشفافية في تسيير الشؤون العمومية.
