الطبيعة القانونية للتحكيم دراسة في قانون الأحوال الشخصية الأردني رقم (36) لسنة 2010

Résumé: ملخص التحكيم عمل عظيم تنبني عليه نتائج هامة، ومقاصد دينية ودنيوية، وللحفاظ على الزوجين، والأسرة، ومصالحهما، وديمومة عقدهما، شُرع التحكيم. وجاءت هذه الدراسة تهدف إلى بيان أهمية التحكيم في الشريعة الإسلامية والقانون. وتناولت هذه الدراسة التحكيم في الشريعة الإسلامية، وطبيعة التحكيم القانونية، والأسباب الداعية للتحكيم في دعاوى التفريق بين الزوجين لدى المحاكم الشرعية الأردنية. وتوصل الباحث في دراسته إلى أن المشرع الأردني قد اعتبر التحكيم في القانون تحكيماً إجبارياً، واغفل المشرع كل ما يتعلق بهذا التحكيم من حيث طبيعتة، ومهمة وعمل الحكم وصفاته.... الخ. ولذا يوصي الباحث بضرورة بيان مفهوم التحكيم من اجل الوصول إلى خصائصه وطبيعته، والنص صراحة في قانون الأحوال الشخصية الأردني، على كل ما يتعلق بالمحكم. ABSTRACT Arbitration is a very important work that includes many important results upon him ,like the religious and everyday life issues, saving the husbands lives, the family, their interests, its continuity … so arbitration became very urgent at this side. This paper aims to shed the lights on the importance of arbitration IN ISALM and law, it dealt with arbitration in Islam, the legal articles, and the reasons for arbitration regarding the legal suits between both husbands in the Jordanian sharite courts. The study concluded that the Jordanian legislator had presumed arbitration as a must in law, but it didn’t take its nature, tasks, characters..Etc into consideration. Upon that the researcher recommended that arbitration must explain arbitration concept in order to reach its nature ,traits and the text directly in the articles of Jordanian personal Affairs ,And every thing regarding the arbitrator…
