الأسئلة البرلمانية في الأنظمة الدستورية المقارنة مع الاشارة للتجربة الدستورية الجزائرية دراسة تأصيلية تحليلية Parliamentary Questions In Comparative Constitutional Systems With Reference To The Algerian Experience Analytical Study

Résumé: يعالج المقال موضوع السؤال البرلماني بوصفه أحد أدوات الرقابة البرلمانية على أعمال الحكومة في الأنظمة الدستورية التي تقوم على مبدأ الفصل المرن بين السلطات ، حيث يعد السؤال البرلماني أحد الوسائل المعول عليها لتقييم العمل الحكومي تمهيدا لتقويمه ، ويميز في هذا الاطار بين نمطي الأسئلة الكتابية والشفوية الشائعة الاستخدام في الممارسة البرلمانية المقارنة خاصة بريطانيا وفرنسا ، وبين نمط الأسئلة الحالة أو المستعجلة الذي يكاد يكون حصري التطبيق في بعض الأنظمة رغم أهميته ودوره ، وسيتم التعرض بالتفصيل لكل نوع من أنواع هاته الأسئلة مع التعرض للتجربة الدستورية الجزائرية في ضوء الدساتير والتعديلات الدستورية وصولا إلى التعديل الدستوري النافذ لسنة 2020. The article deals with the issue of the parliamentary question as one of the parliamentary oversight tools on the work of the government in constitutional systems that are based on the principle of flexible separation of powers. The parliamentary question is one of the reliable means for evaluating government work in preparation for its evaluation, and it distinguishes in this context between the two commonly used types of written and oral questions. In comparative parliamentary practice, especially Britain and France, and between the type of urgent or status questions that are almost exclusively applied in some systems despite its importance and role, and we will discuss in detail each of these types of questions with exposure to the Algerian constitutional experience in the light of constitutions and constitutional amendments leading to the effective constitutional amendment for the year 2020.
